Notice is given to the general public that Subros Educational Society (Regd.) (hereinafter “the Society”) having its office at G-71, Ground Floor, World Trade Centre, Barakhamba Lane, New Delhi-110001 is running and managing nursery/ preparatory & senior secondary Schools in the name and style of “Step by Step” School which are located at Panchsheel Park, Delhi and at Sector-132, Noida, U.P.

The Society is the registered proprietor of the trade mark/name “Step by Step” as well as “Step by Step School” in India interalia in the field of educational services vide Trade Mark nos. 1301298, 1301297 and 1549619 in Classes 16 and 41 respectively. Additionally, the mark ‘Step by Step’ along with its logo is registered under the Copyrights Act, 1957.

By virtue of statutory registrations, extensive publicity and continuous use of these marks by Society over more than two decades, the Society has acquired exclusive rights - statutory and under common law - to the use of these trade marks and copyrighted works, and no one else can lawfully use these without the express prior authority of the Society.

It has come to the Society's attention that certain unscrupulous parties engaged in the school business have been misusing the aforesaid reputed marks of the Society by unauthorizedly promoting their schools and deceiving people at large into believing that there is a certain association/ affiliation/ franchisee of such schools with the Society despite the fact that the Society manages no other school apart from the aforesaid two schools located at Delhi and Noida.

NOTICE is hereby given to the trade that any infringement / misuse of our Client's proprietary rights in its marks depicted above / copyrighted work is punishable under the provisions of the Trademarks Act, 1999 and Copyright Act, 1957 and will be dealt with accordingly without any further reference whatsoever.
